This Legal Notice supplements our Terms of Service and Privacy Policy. It outlines our legal standing, intellectual property rights, mandatory compliance obligations, and our platform's acceptable use framework.

PetaByte operates as a permanent digital vault and email hosting platform, providing individuals and businesses with secure, long-term cloud storage and professional email infrastructure.
2. Intellectual Property Rights
All content, features, technology, trademarks, logos, service marks, and trade dress displayed on or through our services — including but not limited to the PetaByte name, branding, software, code, user interface designs, and written materials — are the exclusive property of PetaByte and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal or business storage needs. This license does not include:
- Copying, modifying, or distributing our software or UI
- Using our branding for any commercial purpose without written consent
- Reverse engineering, decompiling, or attempting to extract source code
- Creating derivative works based on our platform or technology
- Scraping, crawling, or automated data extraction from our platform
Unauthorized use of our intellectual property may result in civil and criminal liability.
3. Content Liability & Safe Harbor
PetaByte is a storage provider and is not responsible for the content users choose to upload, subject to applicable law. We operate in compliance with:
- Digital Millennium Copyright Act (DMCA): We respond to valid DMCA takedown notices. Rights holders may submit takedown requests to legal@petabytemail.com.
- PROTECT Our Children Act / REPORT Act: We are mandatory reporters of child sexual abuse material (CSAM). All discovered CSAM is immediately reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
- CAN-SPAM Act: All marketing communications comply with CAN-SPAM requirements and include opt-out mechanisms.
- GDPR / CCPA: We honor applicable data protection rights for users in the European Union and California respectively.
While we implement proactive content scanning, PetaByte expressly disclaims liability for user-uploaded content that evades detection. Users bear sole legal responsibility for all content they upload.
4. Platform Security & Acceptable Use
To maintain a safe and reliable platform for all users, the following activities are strictly prohibited and may result in immediate termination and legal action:
Security Violations:
- Uploading malware, viruses, worms, ransomware, trojans, or any malicious code
- Attempting to exploit vulnerabilities in our platform or infrastructure
- Unauthorized access to other users' accounts or data
- Using our services to launch attacks against other systems or platforms
- Attempting to circumvent our security scanning systems
- Uploading corrupted or intentionally damaged files designed to cause harm
Content Violations:
- Pornography, sexually explicit material, or nudity
- Child sexual abuse material (CSAM) — zero tolerance, law enforcement will be contacted
- Hate speech, incitement to violence, or discriminatory content
- Copyright-infringing material or pirated content
- Content designed to harass, threaten, or harm individuals
Platform Abuse:
- Creating multiple accounts to circumvent bans or storage limits
- Reselling or sublicensing storage without written authorization
- Using our platform for cryptocurrency mining or other resource abuse
- Automated account creation or bulk scraping
5. Enforcement & Consequences Matrix

Data Archive Protocol: Upon enforcement termination (non-CSAM), compliant data is Gzipped. A signed, time-limited download URL is emailed to the user. After the legally required retention period, all data and account records are permanently deleted with no possibility of recovery.
6. Security Technology Disclosure
PetaByte employs the following security technologies to protect our platform and users:
- Virus & Malware Scanning: Real-time scanning of all uploads via third-party security APIs before storage.
- AI Content Moderation: Automated detection of pornography, nudity, and CSAM via machine learning models for all image and video uploads.
- Encryption: TLS/SSL in transit and AES-256 at rest for all stored data.
- Access Control: Role-based access controls with audit logging.
- Monitoring: Continuous security monitoring and anomaly detection.
- Secure Payments: PCI-DSS compliant payment processing via Stripe.
Security disclosure: No system is 100% foolproof. While we take every reasonable measure to scan and protect against malicious content, users should exercise their own due diligence. If you discover a security vulnerability, please report it responsibly to security@petabytemail.com.
7. DMCA Takedown Policy
If you believe content stored on PetaByte infringes your copyright, please submit a DMCA takedown notice to legal@petabytemail.com containing:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and information reasonably sufficient to locate it
- Your contact information (name, address, phone number, email)
- A good faith statement that the use is not authorized by the copyright owner
- A statement under penalty of perjury that the information in the notice is accurate
Counter-notices may be submitted following the same process. Repeat infringers' accounts will be terminated.
